Subject: Approval of Intergovernmental Agreement Between the City of Naperville, Illinois and Community Unit School District (CUSD) 200.

Background CUSD 200 will be required to enter into a Intergovernmental Agreement (IGA) with the City of Naperville in order to receive Land Cash Land or Land Cash Funds from Pulte Homes for the Naper Commons Development at W. Lucent Lane and Naperville Road in Naperville.

Summary: The Naper Commons residential subdivision is new subdivision being developed in Naperville at the intersection of Naperville Road and W. Lucent Lane by Pulte Builders. Naper Commons will be served by two School Districts (CUSD 200 and Naperville School District 203). Residents of the single family homes (161 in total) and some residents of the townhomes (36) will attend CUSD 200. The remaining townhomes (30) will be served by Naperville School District 203. As a part of the land agreement with the City of Naperville, the builder, Pulte, is required to dedicate land for school sites to serve the immediate and future needs of the residents of the development, or a cash donation in lieu of land dedication, or a combination of both under the City of Naperville Land Cash Ordinance. Pulte will be providing CUSD 200 with a cash contribution in lieu of land dedication. Cash contributions are based on the type of residence and the bedroom mix. The amount of the contribution to CUSD 200 is not yet known, but could be in the range of $500,000 to $1,000,000. The land cash fee will be collected and verified by the City of Naperville at permit submittal. The City of Naperville will distribute land cash funds to CUSD 200 on a monthly basis once they have started collections. The funds will be earmarked for the three CUSD 200 schools serving this subdivision (Whittier Elementary, Edison Middle School and WWSHS). The funds can be used for student or facility needs. CUSD 200 is not expecting to see land cash donations until the middle or later part of 2022 and there is no current plan on how the land cash donations will be used. Once this agenda item is approved, Board Policy 1:20 will be updated to include the City of Naperville.
